1. Acceptance of Terms
By accessing or using PikeLockup ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
PikeLockup is a news and public information periodical that aggregates and displays public arrest records from the Pike County Detention Center. The Service provides access to information that is already a matter of public record under Kentucky law.
This periodical publishes public records and booking photographs under the fair use doctrine for purposes of news reporting and informing the public about matters of public concern.
3. Disclaimer of Warranties
THE SERVICE AND ALL INFORMATION PROVIDED THEREIN ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We make no warranty that:
- The information displayed is accurate, complete, or current
- The Service will be uninterrupted, timely, secure, or error-free
- Any errors in the information will be corrected
All information is sourced from the Pike County Detention Center public records. We do not independently verify the accuracy of this information.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIKELOCKUP AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party on the Service
- Any information obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
In no event shall our total liability exceed one hundred dollars ($100.00).
5. Indemnification
You agree to defend, indemnify, and hold harmless PikeLockup and its operators from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
6. Acceptable Use
You agree not to use the Service to:
- Harass, threaten, or intimidate any person whose information appears on the Service
- Engage in any commercial use of the information without prior written consent
- Misrepresent your affiliation with PikeLockup or any government agency
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service for any unlawful purpose
7. Fair Credit Reporting Act Disclaimer
PikeLockup is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.
You expressly agree that you will NOT use any information obtained from this Service for any purpose covered by the FCRA, including but not limited to:
- Employment screening or hiring decisions
- Tenant screening or housing decisions
- Credit eligibility determinations
- Insurance underwriting
- Any other purpose that would require FCRA compliance
Any use of information from this Service in violation of this section is strictly prohibited and may result in termination of your access and potential legal action. You agree to indemnify and hold harmless PikeLockup from any claims arising from your use of information in violation of this section.
8. Removal Requests
Individuals whose information appears on the Service may request removal if their charges have been dismissed, their record has been expunged, or they have been acquitted. Removal requests are subject to editorial review and require appropriate documentation.

The Service's design, layout, graphics, and original content are owned by PikeLockup and are protected by intellectual property laws. The public records displayed on the Service are government documents and are not subject to copyright protection.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions.
11. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Pike County, Kentucky. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.
12. Modifications
We reserve the right to modify these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of these Terms. Your continued use of the Service after any modification constitutes your acceptance of the modified Terms.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
